Terms of Service

These Terms of Service govern the use of this site and the AI-powered WhatsApp assistant service we provide to businesses (the "Client"). By hiring or using the service, the Client agrees to these Terms.
1. What the service is
We provide an automated messaging assistant that operates within the Client's own business domain, connected to the Client's WhatsApp Business account through Meta's official WhatsApp Business Cloud API. Depending on how it's configured for each Client, the assistant answers frequently asked questions, books appointments, captures leads, or looks up order status.
2. The assistant is automated
The assistant is an automated system built on language models, and it can make mistakes or lack the information needed to answer correctly. Its replies are informational and are not a substitute for professional, medical, legal, financial, or any other kind of advice. When a request falls outside the assistant's configured scope, or it isn't confident in an answer, the conversation is offered a handoff to a person at the Client's business.
3. What the Client is responsible for
- Holding its own WhatsApp Business account, verified with Meta
- Complying at all times with Meta's WhatsApp Business Commerce Policy and Terms of Service
- Providing accurate, up-to-date business information so we can configure the assistant
- Using the service only for lawful purposes within the scope of its own business
4. How the service is billed
The service is billed as a one-time setup fee plus a recurring monthly fee, both in Mexican pesos (MXN). The current amounts and what each fee includes are set out in the commercial proposal given to the Client before signing up.
5. Cancellation and term
The monthly plan has no minimum term: the Client may cancel it at any time with prior written notice, as specified in its commercial proposal. The one-time setup fee is non-refundable once configuration work has started, unless otherwise agreed in writing.
6. Limitation of liability
We do not guarantee that the assistant will be free of errors or interruptions. We are not liable for decisions made based on the assistant's replies, nor for any suspension or restriction Meta places on the Client's WhatsApp Business account for reasons outside our service. In any case, our total liability to the Client is limited to the amount actually paid for the service during the month the incident occurred.
7. Intellectual property
The software, the assistant's configuration, message templates, and materials we develop to provide the service belong to us or to our providers. The Client keeps ownership of its own business information, its brand, and the data of its own customers.
8. Governing law and venue
These Terms are governed by the laws of Mexico. Any dispute arising from these Terms will be submitted to the competent courts of Monterrey, Nuevo León, México, and the parties waive any other venue that might otherwise apply to them.
